This version is written specifically for Filmswork’s business model, including the free website build promotion, Studios W, G, F, and H, multilingual ASEAN support, and the four-year hosting requirement.
1. Acceptance of Terms
By requesting a quotation, placing an order, paying an invoice, or using any Filmswork service, you agree to these Trading Conditions.
2. Free Website Build Offer
Selected website packages may qualify for a free website build promotion.
The free build applies only to the construction of the website and does not include ongoing administration, hosting, domain registration, premium plugins, stock imagery, translation services, content creation, or third-party software unless specifically stated.
Filmswork reserves the right to withdraw or amend promotional offers without notice.
3. Hosting Requirement
Websites built under the Filmswork Free Build promotion must remain hosted with Filmswork for a minimum period of four (4) years from the website launch date.
The Client acknowledges that the Free Build promotion includes development, design, configuration, deployment, and setup services provided by Filmswork at no separate build cost (unless specified in the package). The minimum hosting period forms part of the commercial basis upon which the Free Build offer is provided.
If the Client requests the transfer of a website, domain, website files, database, email services, or associated digital assets to another hosting provider before the expiry of the minimum hosting period, Filmswork reserves the right to charge reasonable fees for migration services, export preparation, technical support, and any unrecovered setup costs associated with the Free Build promotion.
Website Hosting, Software Updates and Licensing
Websites built by Filmswork may include WordPress, premium plugins, themes, extensions, templates, software components, custom integrations, or other commercial products licensed through Filmswork’s developer, agency, or subscription accounts.
Whilst a website remains hosted with Filmswork, software updates, compatibility checks, security maintenance, and applicable licence management may be provided as part of the hosting and maintenance service.
Where a Client chooses to transfer a website, domain, or associated digital assets away from Filmswork hosting, Filmswork’s responsibility for future software updates, security maintenance, compatibility testing, licence renewals, technical support, and vendor support shall cease on the date of transfer.
Following transfer, the Client shall become solely responsible for maintaining all website software, including WordPress core files, plugins, themes, operating systems, server software, databases, security patches, and hosting environments.
The Client shall also become solely responsible for obtaining, renewing, activating, and maintaining any third-party licences, subscriptions, support agreements, premium plugins, premium themes, software products, and related services required for the continued operation of the website.
Filmswork makes no representation that premium functionality, automatic updates, security services, or vendor support will continue following migration from Filmswork hosting unless the Client obtains their own valid licences and subscriptions.
Filmswork shall not be liable for any loss of functionality, interruption of service, software incompatibility, security vulnerability, expired licence, unsupported software, or additional costs incurred after a website has been transferred away from Filmswork hosting.
These provisions apply to all websites built by Filmswork, including websites supplied under Free Build promotions, discounted packages, commercial packages, bespoke development projects, and fully paid website builds.
4. Fees and Payments
All prices are quoted in the agreed currency and are subject to applicable taxes where required.
Invoices must be paid by the due date shown on the invoice.
Failure to make payment may result in suspension of services, website access restrictions, or termination of hosting services.
5. Domain Names
Where Filmswork registers a domain name on behalf of a client, the client remains responsible for all future renewal fees.
Failure to renew a domain may result in service interruption or loss of the domain registration.
6. Website Content
Clients are responsible for supplying accurate text, photographs, logos, and other content unless content creation services have been purchased separately.
Filmswork reserves the right to refuse content that is unlawful, offensive, misleading, defamatory, or infringes third-party rights.
7. Design Revisions
Website packages include reasonable revisions during the development process.
Additional revisions beyond the agreed scope may incur additional charges.
8. Hosting and Maintenance
Studio H provides website hosting and maintenance services including:
Scheduled maintenance may occasionally require temporary service interruption.
9. Performance, Availability and Support
Filmswork aims to maintain high levels of website and email availability and to keep services operating reliably. However, Filmswork does not guarantee uninterrupted, continuous, error-free, or fully secure service, and temporary interruption, delay, degradation, maintenance, or loss of access may occur from time to time.
Downtime, latency, delivery delay, interruption, or loss of availability caused by internet service providers, domain registrars, DNS providers, data centres, cloud infrastructure providers, third-party software or plugin vendors, payment gateways, email providers, content delivery or security services, cyber attacks, malicious traffic, force majeure events, legal or regulatory action, or any other matter outside Filmswork’s reasonable control shall not constitute a breach of these Trading Conditions.
Support for website or email issues is provided by email only to info@filmswork.net. Support requests sent through phone, messaging applications, social media, or other informal channels are not treated as formal support requests unless Filmswork agrees otherwise in writing.
Under normal operating conditions, Filmswork aims to provide an initial response within 1 to 2 business days. For the purposes of this Section, “business days” means Monday to Friday, excluding public holidays in Vietnam, unless Filmswork states otherwise in writing. Response times are targets only, are not guaranteed, and do not mean that a full resolution will be delivered within that timeframe.
The target response period applies only once Filmswork has received sufficient information to identify the affected service and the nature of the issue. Response and resolution times may be longer where an issue involves a widespread incident affecting multiple services or clients, data centre or upstream provider outages, registrar or DNS delays, third-party vendor or software issues, malware or security incidents, complex debugging, monitoring or staged testing requirements, or incomplete information, delayed approvals, or lack of access from the Client.
The Client must cooperate with troubleshooting and provide, where requested, accurate contact details, working access credentials, relevant screenshots, logs, backup copies, and clear steps to reproduce the issue. The Client remains responsible for keeping its own current copies or backups of critical website content, databases, and email unless Filmswork has expressly agreed in writing to provide a separate managed backup service with defined scope and retention. Filmswork may delay or limit assistance where the Client does not provide the information, access, approvals, or cooperation reasonably required.
Depending on the nature of the issue, Filmswork may implement a temporary workaround, restore from a backup where available and appropriate, escalate the matter to a registrar, data centre, cloud provider, software author, email provider, or other third-party vendor, recommend that the Client contact the relevant third party directly, or temporarily suspend or isolate affected services where reasonably necessary to protect security, stability, or other users.
Filmswork shall not be liable for delay, interruption, or failure to resolve an issue within any particular timeframe where the cause is outside Filmswork’s reasonable control, depends on third-party action, or is materially affected by the Client’s failure to provide access, information, approvals, or backups. Any liability of Filmswork remains subject at all times to the limitation of liability provisions elsewhere in these Trading Conditions.
10. Intellectual Property
Upon full payment of all applicable fees, clients retain ownership of content supplied by them.
Filmswork retains ownership of proprietary development methods, frameworks, systems, templates, and internal tools unless otherwise agreed in writing.
11. Motion Design and Graphic Design
Studio G and Studio F projects may include concept designs, artwork, CGI content, animation, video production, and motion graphics.
Final deliverables will be supplied according to the agreed project scope.
Source files may incur additional charges unless included within the original quotation.
12. Multilingual Websites
Filmswork supports websites in multiple ASEAN languages.
Clients remain responsible for reviewing and approving all translated content before publication.
Filmswork is not responsible for translation inaccuracies supplied by third-party providers or client-submitted content.
13. Email Services
14. Cancellation
Clients may cancel services at any time before work commences.
Where work has already begun, Filmswork reserves the right to charge for completed work, allocated resources, and any third-party costs incurred.
15. Limitation of Liability
Filmswork shall not be liable for indirect, consequential, or business losses arising from the use of its services.
The maximum liability of Filmswork shall not exceed the amount paid by the client for the specific service giving rise to the claim.
